Terms of Service
These terms govern the use of services provided by It's Official Notary, LLC (“we,” “us”). By placing an order, signing a service agreement, or applying to join our notary network, you accept these terms.
1. What we do
We coordinate and dispatch commissioned Texas notaries to perform notarial acts on behalf of our clients (title companies, law firms, lenders, businesses, and other authorized requesters). Notarial acts include acknowledgments, jurats, oaths, copy certifications, and where authorized, Remote Online Notarization (RON).
2. What we don’t do — Notarial scope
Texas notaries are not authorized to:
- Explain, interpret, or summarize the contents of a document
- Select certificate language or recommend the type of notarization
- Give legal advice or prepare legal documents
- Act as the unauthorized practice of law
For questions about document content, please consult the attorney, lender, title officer, or other professional who prepared the package. Notaries witness signatures and verify identity; the legal effect of the document is between you and the document's preparer.
3. Orders, scheduling, and confirmation
Order placement does not constitute confirmation. We confirm assignment to a specific notary within 30 minutes during business hours; outside business hours, we respond same-day. If we cannot cover a requested time, we will notify the requester promptly to reschedule or release the order.
4. Fees and billing
Fees consist of two components: (a) the notarial fee, which is capped by Texas Government Code § 406.024 ($10 per acknowledgment signature, $1 per additional signature, $25 additional per RON notarial act, etc.), and (b) the signing service fee, which covers travel, document handling, scheduling, technology, QC, and post-signing shipping. The notarial fee is charged in compliance with statutory caps; the signing service fee is billed to the ordering client, not the signer.
Standard billing terms are net-15 from the date of completion. Rush, weekend, and after-hours fees apply per our published rate sheet. Invoices not paid within terms accrue a finance charge of 1.5% per month.
5. Cancellation and reschedule
Orders cancelled less than 2 hours before scheduled time, or after the notary has departed for the location, are billed at 100% of the standard fee. Reschedules within the same calendar day are not charged unless travel has already been incurred. No-show signers are billed at 100%.
6. Contracted notaries are independent contractors
The notaries who perform signings under our brand are independent contractors, each holding their own Texas notary commission, surety bond, and errors-and-omissions (E&O) insurance. They are not our employees. Each notary is solely responsible for the proper execution of the notarial act in accordance with Texas law.
7. Confidentiality and information security
We treat all non-public personal information received in the course of providing services as confidential. Our handling practices are described in our Privacy Policy. We comply with the FTC Safeguards Rule (GLBA) where applicable.
8. Disclaimers and limitation of liability
Services are provided “as is.” To the maximum extent permitted by law, we disclaim implied warranties of merchantability and fitness for a particular purpose. Our aggregate liability for any claim arising out of or relating to the services is limited to the fees paid for the specific order giving rise to the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages. Nothing in these terms limits liability for fraud, willful misconduct, or amounts not permitted to be limited under applicable law.
9. Indemnification
Each party will indemnify the other for third-party claims arising from its own breach of these terms, gross negligence, or willful misconduct.
10. Governing law and venue
These terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Venue for any dispute is the state or federal courts located in Travis County, Texas.
11. Notary applicants
If you apply to join our notary network, additional terms apply, including a written independent-contractor agreement, separate FCRA disclosure and authorization for any background screening, and verification of Texas commission, surety bond, and E&O coverage. Submitting an application does not guarantee acceptance.
12. Changes
We may update these terms; the “Last updated” date above reflects the most recent revision. Continued use of the services after a change constitutes acceptance.
